Between us, One Son Real Estate LLC (FreeWebsiteFormation.Com) and you, (the undersigned/under ticked).
I always do my best to fulfill your needs and meet your expectations, but it’s important to have things written down so that we both know what’s what, who should do what and when, and what will happen if something goes wrong. In this contract you won’t find any complicated legal terms or long passages of unreadable text. I have no desire to trick you into signing something that you might later regret. What I want is what’s best for both parties, now and in the future.
So in short;
You (the undersigned and/or under ticked), is hiring us One Son Real Estate LLC (FreeWebsiteFormation.Com) to design and develop a website for the estimated total price of $0 zero dollars (assuming you have completely filled out the contact form AND signed up for hosting using my specific link https://freewebsiteformation.website/hosting/cart.php
What do both parties agree to do?
You: You have the authority to enter into this contract on behalf of yourself, your company or your organization. You’ll give me everything I need to complete the project in the format I need. Me: I have the experience and ability to do everything I’ve agreed with you and I’ll do it all in a professional and timely manner. I strive to meet every deadline that’s set, on top of that, I’ll maintain the confidentiality of everything you give me.
Scope of Work, Deliverables and Timeline
Scope of Work
I will provide you with the following
A fully functional, search engine and mobile device friendly website
Theme and plugins installed for you
The site will be completed for you and will include
Home page plus 4 additional pages
About us, Contact us, Products/Services, Blog, Menu
A clickable phone number, a google Map
Pictures, Text, Social Media buttons, videos
A contact form
Basically a “kick-butt” basic website built for you for free
The nitty gritty
I create look-and-feel designs with flexible layouts that adapt to the capabilities of many devices and screen sizes. I work on the WordPress platform and use only premium WordPress themes that are responsive and current with the latest CSS and HTML standards. I use the theme to determine the framework of the site, and then I customize it in a way that will best suit your content and future needs for your site.
You will NOT have the opportunity to review my work prior to delivery, nor provide any feedback. You will, however, be able to easily go into the “backend” of your site upon completion and easily customize, add/delete, change any aspect of the site as you see fit. In short, I am providing you with a framework of a website and may or may not be your ultimate mental picture of your end website.
I’m not responsible for writing new content or typing text from a hard copy. The form that you fill out will have all of the content needed for the website. I reserve the right to edit the content as I see fit.
You will need to supply graphic files in an editable digital format. Photographs should be provided in a high resolution digital format (usually jpg). Logos are best provided in a high resolution transparent png file.
The photographs that you submit must be your property. Copywrite infringement is a very serious crime and I am not responsible for the liability associated with your photographs. In short, if you don’t own the photos do NOT submit them to be a part of your website.
Search Engine Optimization (SEO)
I build every site in a way that is accessible to search engines in an effort to increase its chances to rank well in search engine results. I can’t guarantee any improvement to a website’s search engine ranking, nor can I promise to get a site higher up or to the top of Google without additional SEO work.
Changes and revisions
I will NOT provide any changes or revisions to the website after completion. This is a free service, and cannot be bogged down by revising the site. I will show you how to revise it on your own.
Website Maintenance & Technical Support
It’s important to understand that websites, just like cars, your teeth or your home all require regular maintenance and support in order to keep them in good working order moving into the future. The web is a constantly evolving place. And, therefore, so is the WordPress platform and all of the supporting WordPress plugins and themes that I use to build my sites.
I am not responsible for maintaining your website.
I can’t guarantee that my work will be error-free and so I can’t be liable to you or any third-party for damages, including lost profits, lost savings or other incidental, consequential or special damages, even if you’ve advised me of them.
I agree not to disclose any confidential information to anyone or use it any way other than for the purpose of performing my duties to you, unless of course I am ordered to do so by a Court of Law.
Finally, if any provision of this contract shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this contract and shall not affect the validity and enforceability of any remaining provisions.
You guarantee that all elements of text, images or other artwork you provide are either owned by you, or that you have permission to use them.
When your final payment has cleared, copyright will be automatically assigned as follows:
You’ll own the visual elements that I create for this project. I’ll give you any additional source files and finished file. Keep them somewhere safe, as I’m not required to keep a copy. You own all elements of text, images and data you provided, unless someone else owns them.
I’ll own the unique combination of these elements that constitutes a complete design and I’ll license its use to you, exclusively and in perpetuity for this project only, unless we agree otherwise. In other words, you can’t take the website I designed and copy it to another domain.
I love to show off my work and share what I’ve learned with other people. I reserve the right to display and link to your project as part of my portfolio and to write about it on websites, in magazine articles and in books.
I reserve the right to include a link in the footer portion of your website back to my website. In other words when you receive your completed website, the bottom link on all pages will say something similar to “website proudly built by Http://FreeWebsiteFormation.com given that this is your website you can feel free to remove any part of the website at any time, including footer link.
My service is a free service, you don’t owe me anything. However you must sign up for hosting using my link, and provide me with all of the content that I need.
The fine print
Just like a parking ticket, you can’t transfer this contract to anyone else without my permission. This contract stays in place and need not be renewed. If for some reason one part of this contract becomes invalid or unenforceable, the remaining parts of it remain in place.
Although the language is simple, the intent is serious. This contract is a legal document as governed by the law of the State of New York.
